Common questions about being in removal proceedings.

What is a Notice to Appear?

A Notice to Appear (NTA) is the charging document from the government that alleges you have broken an immigration law, or laws, of the United States and are therefore subject to removal.  If you received this document, you are expected to appear before an immigration judge and can be ordered removed in your absence if you fail to appear.  

Will I receive a government-appointed attorney to defend me?

No.  Removal and deportation proceedings are civil/administrative in nature - not criminal proceedings - so, the government will not appoint an attorney for you.  Representation is solely at your expense.  

Why do I need an immigration attorney?

Immigration law is regarded as one of the most complex areas of law.  Whether you believe your matter is simple, or extremely complicated, it is best to consult with an immigration attorney to prevent serious immigration consequences in the future.  

Can I work while I am trying to get legal status?

Certain applications before the court will entitle you to work authorization during the pendency of your application(s).  It is best to consult with an attorney to determine your eligibility.  

Do I still need to report to ICE if I have a court date?

Yes.  If you have an appointment to check-in with Immigration and Customs Enforcement (ICE), you still need to keep that appointment, even if you have received an NTA for court.  ICE is an immigration law enforcement component of the U.S. Department of Homeland Security.  The immigration court is a separate entity of the Executive Office for Immigration Review, which is under the U.S. Department of Justice.
